Arrested for Prescription Pills

It seems silly, but yes, people are often arrested for having their own prescription pills with them. The police and prosecution, and maybe even the judge have told you that it is a crime if you do not have your prescription pills in the prescription bottle they came in, but that simply is not the law.

Police, prosecution, and the judge may also have told you that it is illegal to have old medications, again this simply is not true.

If you believe you are being wrongfully prosecuted for having your own prescription medication contact Michigan criminal lawyer, Aaron J. Boria today for a free consultation (734) 453-7806.

Is It Illegal To Have Old Prescription Pills?

NO! You are allowed to keep your prescription pills for as long as you want, they may not work that well later, but that’s neither here nor there.

There is no law that requires you toss your old medications after a certain date. If you have had medication prescribed to you then you are allowed to possess that medication and there is nothing the police or prosecution can do about it

Do I Have to Keep My Medication In The Prescription Bottle?

NO! You can keep those pills in whatever container you want. Haven’t you seen those Mon-Sun day pill containers? Those are not what your pills came in but they are perfectly legal. If you need to bring your meds on vacation it may be a good idea to keep them in their container but again it isn’t required.

Police may pull you over and if they see a lose pill they may arrest you. Just because you have been arrested does not mean that you did anything wrong!

Remember, police are allowed to lie to you, prosecutors have an interest in backing their officers and getting money for the state, and judges don’t always know the law, so do not roll over just because they tell you that you did something wrong – you may have been within your legal right.
