Carrying Concealed Weapon Defense

Common defenses to CCW include:

  • You were in a place where you were legally allowed to carry a pistol.

  • You were properly licensed to carry a pistol.

  • The pistol was transported unloaded and in a locked case.

  • You were in a vehicle where a gun was present, but the firearm did not belong to you and you had no control over it.

If any of these defenses apply, and a jury believes it, you must be found not guilty.

Additionally, if the police stopped you illegally or conducted an unlawful pat-down that led to discovering the firearm, the case should be dismissed.

Carrying a Concealed Weapon – What Must Be Proven

In any criminal case, the prosecutor must prove every element beyond a reasonable doubt—you never have to prove anything.

For a CCW charge, the prosecutor must prove the following elements from the statute MCL 750.227:

  1. You knowingly carried a pistol — not by accident.

  2. The pistol was concealed on your person — meaning it was not easily visible to someone encountering you.

  3. For CCW in a vehicle: the prosecutor must prove you knew the weapon was in the car and that you participated in hiding or concealing it.

If even one element is not proven, you are not guilty.
