Aggravated Assault
When you are charged with a crime the prosecuting attorney is the person against you. You should think of them as the person that represents the government and is on the same side as the police.
In any criminal case the prosecuting attorney must prove guilt beyond a reasonable doubt. With aggravated assault charges the prosecuting attorney would have to prove the following elements that would be read by the judge.
The defendant has been charged with assault and infliction of serious injury. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:
- First, that the defendant tried to physically injure another person.
- Second, that the defendant intended to injure the complainant.
- Third, that the assault caused a serious or aggravated injury. A serious or aggravated injury is a physical injury that requires immediate medical treatment or that causes disfigurement, impairment of health, or impairment of a part of the body.
If even one element cannot be proven beyond a reasonable doubt then you must be found not guilty.
Additionally, there are defenses. Not only does the prosecutor have to prove every element beyond a reasonable doubt. On top of that, they also have to prove that you do not have a defense.
If you acted in self-defense, or the defense of another person, or the incident was actually an accident then you are not guilty. It is not your job to prove a defense, but instead the prosecutor’s job to prove you did not act in one of the defenses.
