BAC .17 Or Higher
The State of Michigan passed a law in 2010 that would have greater penalties for someone convicted of an offense where the blood alcohol level was .17 grams per 100 milliliters or higher. This offense became known as the Super Drunk offense; on a ticket the offense is generally written as BAC > .17, or High BAC.
The penalty for being convicted of Super Drunk is up to 6 months in jail, the loss of your license for a year, or a “blow and go” installed on your car after 45 days of a hard suspension for the balance of a year. Fines and costs are also increased for the Super Drunk offense.

We were able to get the Super Drunk High BAC offense reduced to a lesser drinking and driving offense of OWI. By obtaining this reduction our client saved money, her potential jail time was cut in half, and instead of her license being suspended for 45 days it will be 30 days.
Had she been found guilty of the Super Drunk offense, after the 45 day suspension, she would have had to have had a “blow and go” device installed on her car for the duration of a year, but instead, her license will be restricted for 5 months with the result we obtained.
When we went to sentencing we were able to get the judge to agree to an incredibly short term of probation, 9 months. This is something unheard of in a case where the BAC was almost 3 times the legal limit and there was a crash. She was not ordered to do any community service, and most importantly she was not ordered to serve a single day in jail.
