DUI Lawyer – Plymouth, Michigan
Should I hire a lawyer for a drunk driving case?
Criminal lawyer, Aaron J. Boria is located in downtown Plymouth at 472 Starkweather Street. We are half a mile from the courthouse.
We are happy to report that we have tried and won multiple jury trials at the 35th District Court. We have successfully had numerous felony drunk driving charges reduced to misdemeanors and other drunk driving charges dismissed.
In just about every drunk driving case we have handled our clients have been given a reduction to a lesser offense even when they believed they were in the wrong and guilty.
We can also say that, to date, we have never had a client go to jail on a first offense or even a second offense at the 35th district court for a drunk driving offense. A drunk driving will usually result in the suspension of your license but because of our ability to negotiate on our client’s behalf our clients almost always maintain the ability to drive to work, school, medical appointments, and to comply with the court.
Fighting a DUI
Can I fight a drunk driving?
DUI lawyer, Aaron J. Boria, has years of experience defending hundreds of clients, he also as special training that other so called “dui lawyers” lack. Aaron J. Boria has been trained in field sobriety testing and chemical testing. The same field sobriety test that police officers are required to attend. Boria also regularly trains in advanced drunk driving defense and trial skills.
As a true DUI Lawyer, we know how to challenge the stop, challenge the arrest, and challenge the chemical testing.
The police have to be held accountable, which means they have to follow laws when making an arrest and gathering evidence. When police brake the law and violate your rights the evidence they illegally gain must be suppressed which often times will result in a dismissal.
35th District Court – Operating While Intoxicated Procedure
What happens when I am charged with drunk driving?
In most drunk driving cases at the 35th District Court you will be released on a bond the following day after your arrest. Your driving license will be confiscated and you will be given a paper license. You will usually be given a ticket with an appearance date and a print out of your alleged blood alcohol.
Your first court date is an arraignment. At your arraignment you will be given bond conditions and told what the maximum possible penalty is for the offense. You will be given a second court date to called a pre trial. In most cases the 35th District Court will allow your lawyer to waive your arraignment and jump to the pre trial.
At the pre trial your lawyer will sit down and negotiate with the prosecuting attorney on your behalf. Plymouth City and Plymouth Township, Northville City and Northville Township, and Canton Township all have their own prosecutors. Depending on which jurisdiction you were charged in will determine who your attorney meets with.
If a deal can be reached the terms would be put on the record in front of one of the three judges. The judges at the 35th District Court are Judge Plakas, Judge Gerou, and Judge Lowe. Almost all pleas on a drunk driving offense will result in a substance abuse assessment and interview by probation before you are sentenced.
At sentencing the judge can order anything from jail, probation, community service, work detail, alcohol testing and rehabilitation, and more.
If your lawyer cannot work the case out with the prosecutor the matter will be set for an evidentiary hearing or trial. If the matter is set for a trial the judge or the jury will make the ultimate decision as to your guilt.
If you are found not guilty or your case is dismissed you are free to go.
