What happens when I am charged with drunk driving? 

In most drunk driving cases at the 35th District Court you will be released on a bond the following day after your arrest. Your driving license will be confiscated and you will be given a paper license. You will usually be given a ticket with an appearance date and a print out of your alleged blood alcohol. 

Your first court date is an arraignment. At your arraignment you will be given bond conditions and told what the maximum possible penalty is for the offense. You will be given a second court date to called a pre trial. In most cases the 35th District Court will allow your lawyer to waive your arraignment and jump to the pre trial. 

At the pre trial your lawyer will sit down and negotiate with the prosecuting attorney on your behalf. Plymouth City and Plymouth Township, Northville City and Northville Township, and Canton Township all have their own prosecutors. Depending on which jurisdiction you were charged in will determine who your attorney meets with. 

If a deal can be reached the terms would be put on the record in front of one of the three judges. The judges at the 35th District Court are Judge Plakas, Judge Gerou, and Judge Lowe. Almost all pleas on a drunk driving offense will result in a substance abuse assessment and interview by probation before you are sentenced. 

At sentencing the judge can order anything from jail, probation, community service, work detail, alcohol testing and rehabilitation, and more. 

If your lawyer cannot work the case out with the prosecutor the matter will be set for an evidentiary hearing or trial. If the matter is set for a trial the judge or the jury will make the ultimate decision as to your guilt. 

If you are found not guilty or your case is dismissed you are free to go.
