Gross Indecency Dismissed – Royal Oak

Our client went to the Tigers Game with a group of friends on a party bus. While he was there he met a girl and the two of them hit it off. They came back to Royal Oak after the game to hit some bars. He and the girl started kissing in the parking lot between some cars. One thing led to another and things stated to get a bit heated.

Someone driving by saw them and complained to a police officer. When the officer approached them he saw that our client’s penis was exposed. Both he and the girl were arrested for the felony of Gross Indecency. The case was heard at the 44th District Court in Royal Oak.

Luckily, for our client he called criminal defense lawyer, Aaron J. Boria (734) 453-780. We got the original charge dismissed. Our client plead to disorderly conduct, a 90-day misdemeanor and better yet, he didn’t even get probation. A fine and 15 days of community service was all he had to do.

Gross Indecency – Michigan

Had our client been convicted of what he was originally arrested for he would have had a felony on his record and faced 5 years in prison with a fine of p to $2,500. A conviction for this offense could have resulted in deportation for a noncitizen.

To be found guilty of gross indecency at trial the prosecuting attorney would have to prove the following beyond a reasonable doubt:

First that the person charged with the crime engaged in a sexual act, and one of the following are true:

Second, the person charged put his penis, finger, or tongue into another person’s vagina or anus, or, put their penis in a person’s mouth, or touched another person’s genitals with their mouth or tongue, or masturbated, and it was in a public place.
