Michigan Home Invasion Charge Dismissed

Our client was charged with Home Invasion 2nd, a felony that carries up to 15 years in prison and thousands of dollars in fines. Home invasion – Breaking and Entering

MCL 750.110a, states that a person who breaks and enters a dwelling with intent to commit a felony, larceny, or assault in the dwelling, a person who enters a dwelling without permission with intent to commit a felony, larceny, or assault in the dwelling, or a person who breaks and enters a dwelling or enters a dwelling without permission and, at any time while he or she is entering, present in, or exiting the dwelling, commits a felony, larceny, or assault is guilty of home invasion in the second degree.

These cases happen most often where someone breaks into a home or garage and steals something. In this particular case our client was charged under an aider and abettor theory. Meaning that he never entered the garage but a person he was with did. As an aider and abettor you can be charged with any offense the primary defendant is charged with.

Wayne County Diversion

Normally Wayne County Diversion is not granted to Home Invasion cases. This client was having some issues with drugs. He went above and beyond what most people would do who were charged with a crime.
