OWI Success Clarkston Michigan

Our client was at work at a bar and grill on New Years Eve where he works as a cook. When he finished his shift he had a couple of beers, Fat Tire 16oz Pints. He got into his car and began to drive home. According to the arresting officer he was pulled over for swerving in his lane and for his wheels coming off the road and onto the shoulder. He admitted to drinking, and according to the officer smelt strongly of booze. He was ordered out of his car where the officer testified that he failed all field sobriety tests. After his arrest he was taken to the station where a breath alcohol test was done revealing a blood alcohol of .10, which is over the legal limit.

The client was charged with Operating While Intoxicated. He called OWI lawyer, Aaron J. Boria (734) 453-7806.

The Oakland County Prosecutor’s Office prosecutes criminal cases for any matters in Oakland County where the arrest was made by the sheriff or the state police.

The Oakland County prosecutor’s Office is known for not cutting deals and being incredible harsh when it comes to prosecuting defendants. This case was no different. When we initially appeared in court the prosecutor was unwilling to cut a deal in this matter so we set the case for trial.

If found guilty as charged to Operating While Intoxicated (OWI) our client was going to lose his license for 30 days, after 30 days of no driving at all his license would be restricted for another 5 months, he would be hit with $2,000.00 in driver responsibility fees, $500 in court costs, and 6 points would be added to his drivers license.

The jury returned a verdict of Not Guilty to the charge of OWI and guilty to the lesser offense of operating while visibly impaired.

This was a major win given the prosecutors version of the case where our client blew a .10 and failed his field sobriety tests.

As a result to the lesser offense our client will not lose his license. The restriction will be cut down to 90 days but he will be able to drive to work. He will save at least $1,200.00. He will also save two points on his driver’s license. It is also likely that any term of probation will be less.

OWI lawyer, Aaron J. Boria always strive for Not Guilty verdicts across the board, but considering that the prosecutor’s office started out not willing to offer a lesser offense on this case and we obtained it both myself and the client were happy.
