Reckless Driving Penalties

As mentioned above, reckless driving carries penalties that are more stiff then those for a drinking and driving offense.

A conviction for reckless driving means that you will face up to 93 days in the county jail, and fines that will likely exceed a thousand dollars.

In addition to that, for a first offense reckless driving the Michigan Secretary of State will add 6 points to your driving record, and they will suspended your license for two months and restrict your license for another two months on top of that.

There are many ways to fight a reckless driving offense. Each case is different so your matter may have a different defense then someone else’s case.

One major defense to reckless driving is a prosecutor’s inability to prove that you were actually being reckless. There is a lesser offense of careless driving, so the prosecution would have to be able to prove that your behavior went beyond carless to actually being reckless, which means they have to show a willful and wanton disregard of care.

Another defense is that the person that reported you was lying or mistaken about what driving they claim they saw.

A reckless driving conviction cannot be based on speeding alone, so even if you were going 120mph you cannot be convicted without evidence of other indications of reckless driving.
