No Jail for Probation Violation in Washtenaw
Our client was on probation with the Washtenaw Circuit Court for a minimum for 5 years for a low-level sexual assault crime among other things. He had been on probation since 2011 when Operating Night Hawk came to his house and found pornography. While there is nothing illegal about pornography there was a court order that our client not possess any, so having it was a violation of the court order and a violation of probation. Initially, prosecution and probation wanted our client to serve a prison term. Once our client got us on the case the end result was to continue on probation, not a single day in jail spent.
Probation Violation in Michigan
If you are facing a probation violation in Michigan the stakes are high. You can be sentenced to as much jail time for the offense you are on probation for. For example, if you are on probation for possession of marijuana a one year offense and then violate probation by testing dirty you could go to jail for an entire year. Worse yet, if you are on probation for one offense and are charged with a new one you could end up doing time for one or both offenses and stay on probation for the other.
Probation Violation Lawyer
In this particular case we were able to negotiate a deal where our client would plead to the offense and so long as he stayed out of trouble to the sentencing date he would not do any jail time. We came back to court for sentencing and the probation and prosecution honored the deal, and of course the Washtenaw County Judge as well.
