What is Aggravated Assault?
There are many types of assault charges in Michigan. Aggravated Assault is a misdemeanor punishable by up to a year in the county jail, fines and costs, probation, and anger management are also possibilities if convicted.
The prosecution must be able to prove all the elements of the crime in order for the judge or jury to find you guilty. If the prosecutor does not meet all of the elements of the crime then you must be found not guilty.
To prove the crime of Aggravated Assault the prosecution must be able to prove; first, that the defendant tried to physically injure another person.
Second, that the defendant intended to injure another person or to make that person fear that they would be hit.
Third, that the assault caused a serious or aggravated injury. A serious or aggravated injury is a physical injury that requires immediate medical treatment or that causes disfigurement, impairment of health, or impairment of a part of the body.

Self-Defense in Michigan
In this particular case, our client claimed self-defense. In a self-defense case the prosecution has to prove beyond a reasonable doubt that not only did you commit the crime of assault, but also that you did not act in self-defense.
If you acted in self-defense you are entitled to be found Not Guilty. In this case our client argued that a woman in a parking lot was advancing on her and so she swung and hit her in the head with a bag that contained a bottle in order to stop her from attacking her.
