Assault and Battery Dismissed at the 24th District Court
Sometimes an innocent person gets mistakenly arrested and charged with a crime.
That was the case for our client at the 24th District Court in Allen Park. Luckily, he had the right criminal lawyer and after a lengthy court battle we were able to get all charges dismissed.
If you have been charged with a crime that you did not commit you need to contact criminal defense lawyer, Aaron J. Boria (734) 453-7806.
After several discussions with the prosecutor we were able to reach a dismissal. We must commend the city prosecutor for doing the right thing, There was tremendous pressure to convict someone, but the prosecutor did the right thing.
Assault and Battery in Melvindale
Our client was out with his wife celebrating a family member’s birthday party. The party took place at the White Rhino Sports Bar in Melvindale. At the end of the night, when it was time to leave, our client walked out of the bar with his wife. They came in contact with a man that they had never met before. It was clear to our client that the man was looking for a fight. Our client was forced to defend himself. It was discovered later that the attacker had a reputation for being a troublemaker.
While our client was defending himself, one of the attacker’s friends came outside and saw the fight. The friend then got into a fight with another individual outside, not our client. While the fight with the unknown friend was going on the friend was attacked by a third party, an unknown female with a weapon. At this point there are at least five people fighting who do not know each other. According to the friend, he believes the weapon that was used against him was a box cutter. The bouncer came outside and told everyone to leave. The friend suffered significant injuries and went to the hospital.
Our client thought that being attacked by the stranger was the end of it until he and his wife were arrested and told that they would be facing charges accusing them of vichously assaulting the associate.
Had our been convicted of assault and battery he would have faced serious jail time, fines, and responsible for the medical bills. That is when criminal defense lawyer, Aaron J. Boria got on the case.
In Court Identification
The associate was named the victim in this case, but we knew our client was not the person who cut him. There was a major identity issue in this case. We arranged to have the victim identify the parties involved in the matter. The victim stated with certainty that neither our client nor his wife were the assailant. The wife’s case was dismissed.
Due to the severity of the injuries in this case, and the fact that a fight occurred involving out client, the prosecutor was reluctant to dismiss the matter and even considered charging out client with disturbing the peace. It isn’t uncommon for a prosecutor to offer a reduction in a case in hopes of getting some kind of conviction even in a case where criminal actions are questionable.
After several court appearances and negotiating, the prosecutor did the right thing and dismissed the charges against our client. The victim himself stated the attacker was not our client. Our client’s statement was consistently that the only reason he was in a fight was because he was forced to defend himself against an attacker.
A warrant went out for two others believed to be the attackers.
