Hearing Officer Overturned – Driver License Restored

Our client had been convicted of two drinking and driving offenses within seven years of each other and as a result the Michigan Secretary of State revoked his driving privileges.
About a year prior to having full privileges, we had a hearing with the Driver Assessment and Appeal Division and successfully obtained a restricted driver license. A Breath Alcohol Ignition Interlock Device (BAIID) was installed on his vehicle and after a little over a year of safe driving he was eligible for a full license.

During the year, the interlock device malfunctioned on a few occasions falsely reporting a blood alcohol level. Our client was smart and went to the nearest police station and performed a PBT. Thinking he would save some money he represented himself for his second hearing to removed the device and gain full privileges.
When his second hearing came around to get a full license he went without our office and tried to represent himself. Despite having the PBT receipt, the hearing officer denied his license because of the false positive on the BAIID.

The client came back to our office and we appealed the matter to circuit court. We sued the Michigan Secretary of State who was represented by the Attorney General’s office. Our basis was that the hearing officer’s ruling was not supported by the facts. The circuit court judge agreed with our position and granted a full license to our client.
He did not have to go back for another secretary of state hearing; he simply got his full license.
