Domestic Violence and False Allegations
The problem with prosecutors and domestic violence is that they will rarely dismiss the charge once it is issued. To make matters worse, domestic violence is probably one of the most falsely accused crimes our office has comes across. We believe that the community puts a great deal of pressure on prosecutors to prevent domestic violence, as they should, but as a result many innocent people get caught in the mix.

Domestic violence, or domestic assault, is often used by one party against another to gain leverage in divorce and child custody battles. All it takes is someone to make an allegation and the other party ends up going to jail.
Domestic violence is also used in situations where one party is mad at the other and makes a false allegation just to make sure that person gets arrested.
What is Domestic Assault?
All crimes are made up of elements. The crime of domestic violence is made up of two elements:
1. That the person accused either assaulted or battered the complainant. A battery is the forceful, violent, or offensive touching of a person, a battery must be intentional, and accidents don’t count. An assault is an attempted battery.
2. The person that the assault or battery was committed on must be related, or in a dating or living relationship with the accused.
If either of these elements cannot be met then the accused is entitled to a not guilty verdict.
Domestic Assault Defense
If any element of a crime cannot be proven then the person accused must be acquitted. Other ways to defend this offense would include that it did not happen or that the accused was actually acting in self-defense, or the defense of others.
