How to Win a Driver License Appeal
Our client had been convicted of two prior drinking and driving offenses, multiple drug crimes, minor in possession of alcohol, and disorderly person.
Our client had completed countless rehabilitation programs through probation. Once she was off of probation she kept going to church and maintained her sobriety. It was a long road, she first had to drive for a year on a breath alcohol ignition interlock device, a blow and go, but in the end she was granted full license privileges on the spot at her hearing.
The burden is on the petitioner to prove by clear and convincing evidence that they are abstinent and will stay that way indefinitely. Abstinent, as defined by the secretary of state, means that you have been sober for AT LEAST one year. That means no a sip of booze or even a joint for a minimum of one year. Even if you were never accused of driving on drugs you still will be expected to be abstinent from drugs including marijuana. It does not matter that marijuana is now legal in Michigan, if you want your driver license back you cannot use marijuana recreationally.
Keep in mind that simply promising that you have learned your lesson and will never drink and driving again is not enough. To get your license back you must prove complete and total sobriety.
To meet the burden you will have to provide a MINIMUM of three support letters. Support letters do not mean three friends that are willing to whine about how tough things have been for you without a license. Support letters mean sworn statements about your sobriety.
Other support evidence can include a clean drug screen or multiple drug screens. A favorable substance abuse evaluation is imperative. Proof of AA attendance or some other support whether it is formal or informal is also helpful.
You need to be ready with your testimony. The hearing officer is going to put you under oath and have a lot of questions for you. You need to be ready to answer their questions properly.
If you are successful at your hearing you will be granted driving privileges with an interlock device. After one year of clean driving, continued sobriety, and no other issues you can apply for a full license.
