Michigan law defines “motor vehicle” in MCL 257.33 and specifically lists items that are not considered motor vehicles, including:

Here’s the important part: most electric scooters—like the ones offered by Bird, Lime, and Uber—fall under the electric skateboard category defined by MCL 257.13f. That means they are not motor vehicles under Michigan law.

There was a time when someone in Grand Rapids, Michigan, was convicted of a drinking and driving offense while riding an electric scooter. But after the legislature clarified the law, electric scooters were explicitly excluded from DUI charges. Today, you cannot be convicted with a DUI on one of these scooters in Michigan.
